Terms and Conditions for Artists

Effective Date: As enrolled as a member

Welcome to Art to Doors! These Terms and Conditions (“Agreement”) govern the relationship between Art to Doors (“Company”) and the Artist (“Artist/Artists”). By registering and using our platforms, you agree to the following terms:

1. Agreement Overview

This Agreement establishes the terms under which the Artist grants the Company the rights to sell their artworks as art prints on Amazon and other e-commerce platforms in various formats, including but not limited to canvas frames.

2. Exclusivity and Ownership

  • The Artist grants the Company the exclusive rights to sell their artwork in the form of prints on Amazon and other platforms under the Company’s brand.
  • The Artist retains ownership of the original artwork but agrees not to sell the same artwork as prints through other sellers on Amazon.

3. Fees and Charges

3.1 Setup Fee

  • The Artist agrees to pay a one-time non-refundable setup fee as per the selected plan, plus convenience charges for account setup and optimization on Amazon.

3.2 Product Upload Fee

  • The Artist agrees to pay a per-product upload fee plus applicable payment gateway charges.
  • The Company reserves the right to revise these fees based on market conditions, with prior notification via email.

4. Termination of Agreement

  • Either party may terminate this Agreement by providing email notice.
  • Termination will take effect within 45 to 60 days of notification.
  • Upon termination, the Company will remove the Artist’s products from its seller account and ensure they are no longer sold under the Company’s brand.

5. Originality of Artwork

  • The Artist guarantees that all submitted artworks are original.
  • If an artwork is found to be copied or infringing on another artist’s work, a penalty of ₹1000 per infringing artwork will be imposed on the Artist.

6. Compensation and Royalties

  • The Artist will receive a royalty for each sale made.
  • The earnings per sale can be accessed via this link: Artist Earning Sheet.
  • The Company reserves the right to adjust profit margins to ensure business sustainability, with prior notification.
  • If a product is returned within Amazon’s 10-day return policy or any other applicable e-commerce platform policy, no royalty will be paid for that sale.

7. Updates on New Formats

  • The Company will notify Artists about new formats of art prints and the associated costs through the best possible communication method.

8. Sales Guarantee Disclaimer

  • The Company does not guarantee any sales of artworks.
  • The Company ensures the Artist’s products are made live on Amazon and other platforms, but it is not responsible for product removal due to unforeseen circumstances.

9. Amendments and Modifications

  • This Agreement constitutes the entire understanding between the Company and the Artist.
  • Any modifications to this Agreement must be made in writing and signed by both parties.

10. Governing Law and Dispute Resolution

  • This Agreement shall be governed by the laws of Mumbai Jurisdiction.
  • In case of disputes, both parties agree to first seek resolution through mediation before initiating legal action.
